Thanks for your comment. My understanding is this guidance from the FDA is regarding "tests" and the most common impact on labs will be with LDT's using RUO/IUO reagents. You can read CAP's comments on this at http://www.cap.org/apps/cap.portal?_nfpb=true&cntvwrPtlt_actionOverride=%2Fportlets%2FcontentViewer%2Fshow&_windowLabel=cntvwrPtlt&cntvwrPtlt%7BactionForm.contentReference%7D=statline%2Findex.html&_state=maximized&_pageLabel=cntvwr#Story4

What about the recent FDA draft guidance on RUO/IUO diagnostics. This guidance tells us that FDA will consider sale of a diagnostic product labeled RUO to a customer known to the seller to be using the product for clinical diagnostic applications, as evidence that the seller has a new intended use for the device. Servicing such products is also cnsidered evidence that the seller has a new intended use. 0

I totally agree with you. I have worked as a generalist in a large hospital laboratory, but am currently working as an andrologist/lead tech in in andrology laboratory, where the majority of our work relates to infertility. I have the advantage of meeting each of our patients because of the nature of the collection of the specimens I analyze. The patients often have many questions that they either don't feel comfortable asking their physician or that their physician does not know the answer to. I also feel constrained as to the amount of information I can impart to the patient without "stepping on" the physician's toes so to speak. The laboratory is the expert on what they do, and they are best able to answer detailed questions because they deal with the situations each and every day with many patients from many different physicians. I believe this type of interaction with the patients would be difficult with most hospital laboratories unless the laboratory would be able to begin a dialogue with their physician base to see if this would be helpful to them.

Awesome summaries of digital pathology presentations at USCAP! Gee, wish I had been there. I checked out the Phillips instrument at last year's USCAP in Washington and have been surprised that it has taken them this long to get their product out. Also, whassup with Omnyx?! I thought they were supposed to have a product LAST year.
